This Online Privacy Policy and Cookie Notice (“Privacy Policy”) outlines the personal data handling practices for Luxer Urgent Care’s website (www.luxerurgentcare.com), electronic health record (“EHR”) application DocVilla, and other online services platforms incorporated by reference herein (“Online Services”).
This Privacy Policy addresses the personal data handling practices of Luxer Urgent Care (collectively, “Luxer,” “we,” “us,” or “our”) and any other partner or affiliated entity referenced in this notice and also supplements Luxer’s Online Services Terms of Use. By accessing or using our Online Services, clicking “I Accept,” or creating an account, you are consenting to this Privacy Policy and the collection of data described herein. If you do not consent, you may not use our Online Services.
If you are a patient of Luxer, this Privacy Policy is separate from Luxer’s Notice of Privacy Practices, which addresses how we collect, use, and disclose your information that is considered protected health information under the Health Insurance Portability and Accountability Act (“HIPAA”). This Privacy Policy does not apply to information that is protected health information under HIPAA.
Please note: This website may contain links to other sites for your convenience or information. If you access those links, you will leave the Luxer website. Luxer does not control those websites or their privacy practices, which may differ from Luxer’s practices. Luxer is not responsible for the privacy policies of third parties that operate any other website, application, or platform, even if it is linked from our Online Services. We recommend you review any third party’s privacy policies and cookie notices, if any, before using any third-party website, application, or platform.
2. NOTICE TO NON-U.S. RESIDENTS AND NON-CALIFORNIA RESIDENTS.
Luxer provides services in the State of California, United States. We are subject to certain United States federal and California state laws and regulations that govern the privacy and security of patient healthcare information. The data protection laws of other countries and other states may differ as to how your personal information is protected. As a non-U.S. resident or non-California resident, when you use our Online Services, provide your personal or other information to us, or direct your healthcare provider to provide your information to us, you acknowledge and consent that Luxer may process your information subject to the applicable state laws of California and federal laws of the United States.
3. SITE SECURITY DISCLOSURE.
Luxer’s Online Services have reasonable security measures in place to protect against the loss, misuse, and alteration of the information under our control. PLEASE NOTE THAT, BY ITS VERY NATURE, NO DATA STORAGE SYSTEM OR TRANSMISSION OF DATA OVER THE INTERNET OR OTHER PUBLIC NETWORK CAN BE ABSOLUTELY SECURE. LUXER URGENT CARE, ACCORDINGLY, CANNOT AND DOES NOT GUARANTEE THE COMPLETE SECURITY OF ELECTRONIC INFORMATION.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a login or password for access to certain parts of our Online Services, you are responsible for keeping this login and password confidential. Luxer does not knowingly solicit, collect, or accept any information from or about children via this website or its other Online Services. The Children’s Online Privacy Protection Act of 1998 (COPPA) addresses how information is gathered and used from children under the age of 13. We are serious about children’s privacy.
Luxer Urgent Care’s Online Services are directed at an adult audience and are not intended or designed to attract children under the age of 13, and with the exception of certain information in DocVilla as authorized by law, we do not knowingly collect, maintain, or use personal information from children under 13 years of age.
If we become aware that a person submitting personal information through any part of our website is a child, we will delete the information as soon as we discover it and do not use it for any purpose, nor do we disclose it to third parties.
If you learn that your child has provided us with personal information through our Online Services without your consent, you may alert us at (805) 410-4203. If we learn that a child has provided such personal information, except as required and authorized by law, we will take steps to delete such information.
